New Jersey’s Updated Lead-Safe Certification Law
Effective July 22, 2022, New Jersey’s Lead-Safe Certification law mandates lead paint inspections for all rental properties built before 1978. The law introduces new inspection timelines and requires different testing methods based on your property’s location. Key Information for Landlords:
The new requirement is officially known as the Lead-Safe Certification Act.
Landlords must provide tenants with proof of lead-safe certification and include a copy as an attachment to the lease agreement.
Properties built after 1978 are exempt, and certain multi-unit dwellings (three units or more) may also qualify for exemptions. [Learn more about exemptions here.]
All non-exempt rental properties built before 1978 must undergo a lead-safe inspection either at the next tenant turnover or no later than July 22, 2025.
Once issued, the Lead-Safe Certification remains valid for three years.
What Municipalities Need to Know
Under New Jersey’s new Lead-Safe Certification law, municipalities are now responsible for enforcing and monitoring landlord compliance with lead paint inspection requirements. According to the New Jersey Department of Community Affairs, municipalities must maintain detailed records of all affected dwellings, including inspection dates, results, and tenant turnover information.
